The Manager of Labour and Employment plays a major role in the ongoing maintenance and administration of the Labour and Employment Centre of Expertise through collective bargaining, grievance management, and pay equity reviews/initiatives. This role will also drive resolutions to concerns brought forward through the Labour Board, Human Rights and other Administrative Tribunal Complaints as required.
Lead collective bargaining through consultation, negotiation, conciliation, interest arbitration while maintaining our corporate strategy;
Effectively manage the grievance process by providing consultation support to the Regional Human Resources Business Partner (HRBP) and lead mediation/rights arbitration;
Strategize best approach and gather required information and evidence related to rights mediations/arbitrations and related legal proceedings;
Conduct effective interviews with managers and witnesses to ascertain relevant facts as appropriate;
Prepare exhibits, submissions and briefs;
Act as chief spokesperson/legal counsel for the organization in mediations and hearings under labour/employment-related administrative tribunals/processes and law courts;
Respond to legal queries, issues and concerns from union lawyers, managers, etc.;
Provide analyses and legal advice to managers and HR staff on a range of labour/employment related matters such as discipline, collective agreement interpretation, policy implementation, investigations, negotiations, etc.;
Draft and/or review letters, papers, policy, collective agreement language, complaints, responses, etc.;
Attend internal meetings and provide legal advice and direction as required;
Provide overview of HR-related legislative changes for communication to management and Human Resources staff;
Develop communications and training, where applicable, for management and Human Resources staff on labour/employment law issues and changes;
Engage and liaison with external legal counsel where applicable;
Advise operational units and work with senior executives on sensitive matters of strategic importance;
Act as an organizational resource to the organization with respect to pay equity in the retirement residences and long-term care homes;
Coordinate pay equity throughout the organization and provides advice, assistance and education on all matters relating to pay equity;
Assist with the development and maintenance of pay equity data bases as required;
Respond and represents the organization before the Pay Equity Commission/Tribunal on matters related to pay equity including the drafting of submissions and position statements to the government and other agencies, and participates in the oral presentation of same, as necessary;
Respond to union organizing drives, certification, decertification and employee list applications including preparation of necessary documentation, communications and training;
Advise and support the RHRBP and Director of HR on all employee labour-relations matters;
Provide guidance and, where applicable, lead complex case management: whistleblower complaints, executive complaints and sensitive investigations in partnership with relevant stakeholders across the regional group;
Develop and implement employment/labour related tools and processes (i.e. grievance procedure and supporting tools, patterned absenteeism management tool-kit, etc.);
Monitor and understand changes to applicable jurisprudence and legislation and incorporate such changes into policies and processes as necessary;
Oversee and/or advise with respect to special projects including organizational change initiatives (i.e. merger, acquisition, divesture and reorganization;
Establish and produce all employment and labour related metric data and for internal stakeholders;
Uphold and promote the values relating particularly to ethics, morality, and integrity as set out in Revera’s Code of Conduct; and
Complete all other tasks as assigned.
University degree(s) in a related field (i.e. Labour Relations, Industrial Relations, Law) with ten (10) years’ progressively responsible experience in labour relations and/or human resources, or an equivalent combination of education and experience
Extensive experience as a spokesperson in collective bargaining experience as a chief spokesperson with multiple unions
Must have extensive labour relations experience dealing with grievances, arbitration preparation and presentation, collective agreement interpretation
Strong knowledge and experience with Union collective agreements
Strong knowledge of applicable of employment/labour legislation and legal principles
Experience in labour and employment research and analysis, labour economics, human resources functions with a union workforce or related area
Strong analytical and problem-solving skills, with demonstrated ability to deal effectively with contentious and controversial issues
Well organized, with excellent attention to detail and accuracy
Ability to multitask while working under tight deadlines
Excellent written and oral communications skills
Well-developed computer skills with advanced Excel knowledge
CRSP designation (Canadian Registered Safety Professional) is a definite asset
